These Terms & Conditions ("Terms") form a binding agreement between you and Rally Getaway ("Rally Getaway", "we", "us") and govern your use of our website and services (the "Service"). Rally Getaway is the seller's legal business name and public-facing seller name for the Service, and references to "Rally" elsewhere on the site refer to Rally Getaway.
By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation (such as a chapter or student group), you confirm that you have authority to bind that organisation to these Terms. You must be at least 18 years old to use the Service.
Rally Getaway is a group trip planning platform that helps event organisers discover vendors, send outreach emails, and manage planning. We are a planning and communication tool — we are not a travel agency and do not book travel, hotels, transport, or venues on your behalf. Vendor pricing and availability are provided for information only and are subject to the vendor's own terms.
You must not misuse the Service. In particular, you agree not to:
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
The Service, including all software, content, branding, designs, documentation, vendor directory structure, and Rally Getaway trademarks, is owned by Rally Getaway or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose during your subscription. No other rights are granted. You retain ownership of the content you submit through the Service and grant us a limited licence to host and process it solely to provide the Service.
Rally Getaway offers an annual chapter membership at $100 USD per chapter per year. Once activated, the membership unlocks vendor outreach for everyone in the same chapter (matched by chapter name and school) until the end of the paid period.
Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms, together with our Refund Policy.
Subscriptions renew automatically each year using the payment method on file unless cancelled before the renewal date. You can manage or cancel your subscription at any time from your Rally Getaway account page, which opens Paddle's secure customer portal.
Refunds are described in our Refund Policy and are handled by Paddle as Merchant of Record.
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, create security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time by cancelling your subscription and, if you wish, requesting account deletion. On termination, your access ends and we will delete or anonymise your data in line with our Privacy Notice and applicable law.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Rally Getaway disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific vendor outcome will be achieved.
To the fullest extent permitted by law, Rally Getaway will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill. Our total aggregate liability arising out of or relating to the Service in any 12-month period is limited to the fees you paid to us (via Paddle) for the Service in that period. Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded by law.
You agree to indemnify and hold harmless Rally Getaway against claims, losses, and reasonable legal costs arising from your content, your use of the Service, or your breach of these Terms.
We may update the Service and these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the seller's jurisdiction, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection law in your country of residence provides otherwise.
